November 26, 2012 - The FDA suspends Sunland Inc.’s Food Facility Registration; Facility Prohibited from Distributing Food
In the interest of protecting public health, the U.S. Food and Drug Administration suspended the food facility registration of Sunland Inc., a producer of nuts, and nut and seed spreads. Registration with the FDA is required for any facility that manufactures, processes, packs, or holds food for consumption in the United States. If a facility’s registration is suspended, that facility is prohibited from introducing food into interstate or intrastate commerce.
The fact that peanut butter made by the company has been linked to an outbreak of Salmonella Bredeney that has sickened 41 people in 20 states, coupled with Sunland’s history of violations led FDA to make the decision to suspend the company’s registration.
This was the FDA’s first use of its registration suspension authority, under the Food Safety Modernization Act. This new authority enables the agency to take this action when food manufactured, processed, packed, received, or held by a facility has a reasonable probability of causing serious adverse health consequences or death to humans or animals, and other conditions are met.
A review of Sunland Inc.’s product testing records showed that 11 product lots of nut butter showed the presence of Salmonella between June 2009 and September 2012. Between March 2010 and September 2012, at least a portion of 8 product lots of nut butter that Sunland Inc.’s own testing program identified as containing Salmonella was distributed by the company to consumers.
Additionally, during its inspection of the plant in September and October 2012, the FDA found the presence of Salmonella in 28 environmental samples (from surfaces in production or manufacturing areas) and in 13 nut butter product samples and one product sample of raw peanuts. Four of the peanut butter product samples showed the presence of the outbreak strain of Salmonella Bredeney.
The suspension order offers Sunland, Inc. the opportunity to request an informal hearing on certain issues related to the order. If, after providing this opportunity, the FDA determines that the suspension remains necessary, the FDA will require Sunland, Inc. to submit a corrective action plan to address the immediate problems and to implement a sustainable solution to those problems in a sound scientific manner. The FDA will reinstate Sunland, Inc.’s registration only when FDA determines that the company has implemented procedures to produce safe products.

The U.S. Food and Drug Administration along with the Centers for Disease Control and Prevention (CDC) and state and local officials are investigating a multi-state outbreak of Salmonella Bredeney infections. We are moving quickly to learn as much as possible and prevent additional people from becoming ill. We recognize that people will be concerned about this outbreak, and we will continue to provide updates and advice.
The FDA’s top priority is protecting consumers and ensuring the safety of our food supply. The FDA, the CDC and state and local public health officials are investigating a multi-state outbreak of SalmonellaBredeney infections linked to peanut butter made by Sunland Inc. of Portales, New Mexico. The linked peanut butter was Trader Joe’s Valencia Creamy Salted Peanut Butter, with a Stock Keeping Unit (SKU) identifier of 97111.
The CDC reports a total of 41 people infected with the outbreak strain of Salmonella Bredeney from 20 states.
Once FDA became involved in this fast-moving outbreak investigation, we began coordinating and working closely with the CDC and several state health departments, which have been leading their own investigations. On September 20, FDA, the CDC and the state of California briefed Trader Joe’s on the status of the investigation, and the company voluntarily removed the suspected product from their store shelves. Trader Joe’s has also posted a customer advisory on their internet page and initiated a recall.
As part of its investigation, FDA contacted Sunland Inc., which makes Trader Joe’s Valencia Creamy Salted Peanut Butter. On September 23, FDA and CDC briefed Sunland Inc. on the status of the investigation and the company voluntarily recalled the almond butter and peanut butter products that were manufactured on the same product line as Trader Joe’s Valencia Creamy Salted Peanut Butter between May 1 and September 24, 2012.
On the evening of September 24, Sunland Inc. expanded their recall to about 100 products, which include peanut butter and other products made with nuts and seeds.
On October 4, Sunland Inc. expanded its ongoing recall to include all products made in the Sunland nut butter production facility between March 1, 2010 and September 24, 2012. The company reports that it is adding 139 products to the recall, bringing the total number of products being recalled by Sunland Inc. to 240.
This expansion covered all previously identified Peanut Butter, Almond Butter, Cashew Butter, and Tahini products as well as Roasted Blanched Peanut Products. New product categories added to the list were several varieties of flavored butters and spreads, including Thai Ginger Butter, Chocolate Butter and Banana Butter.
In the expansion on October 4, Sunland Inc. added forty-nine (49) products that are currently within the manufacturer’s recommended shelf-life, that is, the “Best-If-Used-By” dates have not expired. The expansion also covered ninety (90) products consumers may still have in their homes which are older than the “Best-If-Used-By Date”.
On October 5, The FDA announced that environmental samples taken in the Sunland Inc. nut butter production facility show the presence of Salmonella. Subsequent analysis determined that SalmonellaBredeney with a DNA fingerprint that is the same as the outbreak strain was present in the samples. Environmental samples are samples taken from various surfaces in the production or manufacturing facility that would likely harbor bacteria.
Additionally, FDA analysis has confirmed that peanut butter made in the Sunland nut butter facility shows the presence of Salmonella with a DNA fingerprint that is the same as the outbreak strain of Salmonella Bredeney. Also, testing conducted by the Washington State Department of Agriculture laboratory isolated the outbreak strain from an opened jar of Trader Joe’s Valencia Creamy Peanut Butter collected from a case-patient’s home.
On October 12, Sunland Inc. expanded its ongoing recall to include raw and roasted shelled and in-shell peanuts sold in quantities from 2 ounces to 50 pounds which are within their current shelf life or have no stated expiration date.

As part of the continuing investigation, the FDA inspected the Sunland Inc. production facilities, which include a building in which peanuts are processed and a separate building in which nut butters are made. On October 13, FDA announced that testing has found the presence of Salmonella in raw peanuts from the peanut processing facility. Environmental samples taken from this building also show the presence of Salmonella.
On November 14, the FDA made the observations from its recent inspection of Sunland Inc. publicly available. This inspection was conducted between September 17 and October 16, 2012, and became part of the investigation of the Salmonella Bredeney outbreak linked to peanut butter made by Sunland Inc.
During this inspection investigators found that conditions in the company’s facility, the company’s manufacturing processes, and the company’s testing program for Salmonella may have allowed peanut butter that contained Salmonella to be distributed by the company.
The FDA found that between June of 2009 and August of 2012, Sunland Inc. had distributed, or cleared for distribution, portions of 11 lots, or daily production runs, of peanut or almond butter after its own testing program identified the presence of at least one of nine different Salmonella types (Arapahoe, Bredeney, Cerro, Dallgow, Kubacha, Mbandaka, Meleagridis, Newport, and Teddington) in those lots. Two of these lots showed the presence of the outbreak strain of Salmonella Bredeney.
Equally important, five product samples collected and analyzed by FDA from Sunland Inc. showed the presence of Salmonella, but had not been identified as containing Salmonella by Sunland Inc.’s internal testing. Among those products were peanut butter and shelled raw peanuts. Two of these samples showed the presence of the outbreak strain of Salmonella Bredeney.
Additionally, during its inspection of the plant in September and October 2012, the FDA found the presence of Salmonella in 28 environmental samples. Three of these samples showed the presence of the outbreak strain of Salmonella Bredeney.
Upon identifying the contaminated peanut butter, FDA investigators informed the company and called for corrective action. On October 4, 2012 Sunland Inc. expanded its ongoing recall to include all products made in the Sunland Inc. nut butter production facility between March 1, 2010 and September 24, 2012.
Upon identifying the contaminated shelled raw peanuts, FDA investigators informed the company and again called for corrective action. On October 12, 2012 Sunland Inc. expanded its ongoing recall to include raw and roasted shelled and in-shell peanuts sold in quantities from 2 ounces to 50 pounds which are within their current shelf life or have no stated expiration date.
Additionally, investigators found that employees improperly handled equipment, containers, and utensils used to hold and store food. Employees handling peanut products wiped gloved hands on street clothes and other times failed to wash their hands or change gloves. There were no hand washing sinks in the peanut processing building production or packaging areas and employees had bare-handed contact with ready-to-package peanuts.
There were no records documenting the cleaning of production equipment. The super-sized bags used by the firm to store peanuts were not cleaned despite being used for both raw and roasted peanuts. There was a leaking sink in a washroom which resulted in water accumulating on the floor, and the plant is not built to allow floors, walls and ceilings to be adequately cleaned.
Finally, investigators found that raw materials were exposed to potential contamination. Raw, in-shell peanuts were found outside the plant in uncovered trailers. Birds were observed landing in the trailers and the peanuts were exposed to rain, which provides a growth environment for Salmonella and other bacteria. Inside the warehouse, facility doors were open to the outside, which could allow pests to enter.
Consumers should not eat the recalled products. This is especially important for children under the age of 5 years, elderly adults, and people with weak immune systems.
For the raw and roasted peanuts sold by Sunland Inc.Consumers who have purchased any of the recalled products are urged to return products within their current shelf life to the place of purchase for a full refund or dispose of them immediately. The “Best-If-Used-By” date or product expiration date is printed on the packaging. The UPC used to identify the recalled products is located below the bar code on all products.
The roasted and roasted/salted peanuts being recalled were distributed during the six month period prior to the recall date (April 12, 2012 – October 12, 2012), and will have best by/expiration dates on the packaging from October 12, 2012 through April 12, 2013.
The raw peanuts being recalled (shelled and in-shell), were distributed during the twelve months prior to the recall date (October 12, 2011 – October 12, 2012), and will have either best by dates from October 12, 2012 through October 12, 2013 on the packaging, or a “Crop Year” marking on the package of 2011 or 2012, up to and including October 12, 2012.
In-shell peanuts that were sold in 2, 5 and 10 pound mesh bags (raw, roasted and salted/roasted) do not include an expiration date on the mesh bags. These products should not be eaten and should be returned to the place of purchase for a full refund or disposed of immediately.
All expired products should be discarded. Customers who purchased products directly from the company’s website should discard the products and contact the company at 1-866-837-1018.

All products with “Best-If-Used-By” dates of March 1, 2011 or later should be discarded or returned immediately.
Consumers who have products which are within their current shelf life (“Best-If-Used-By” dates of October 4, 2012 and later) should return the products to the place of purchase for a full refund or discard them. All expired products (“Best-If-Used-By” dates of October 4, 2012 and earlier) should be discarded.

Most people infected with Salmonella develop diarrhea, fever, and abdominal cramps 12 to 72 hours after infection. The illness usually lasts 4 to 7 days, and most people recover without treatment.
However, in some people, the diarrhea may be so severe that the patient needs to be hospitalized. In these patients, the Salmonella infection may spread from the intestines to the blood stream, and then to other body sites and can cause death unless the person is treated promptly with antibiotics.
Children are the most likely to get salmonellosis. The rate of diagnosed infections in children less than five years old is higher than the rate in all other persons. Young children, the elderly, and those with compromised immune systems are the most likely to have severe infections. It is estimated that approximately 400 persons die each year with acute salmonellosis.

FDA, the CDC and the state of California briefed Trader Joe’s on the status of the investigation, and the company volunteered to remove the suspected product from their store shelves. Trader Joe’s has also posted a customer advisory on their internet page and initiated a recall.

As part of its investigation, FDA contacted Sunland Inc., which makes Trader Joe’s Valencia Creamy Salted Peanut Butter. On September 23, FDA and CDC briefed Sunland Inc. on the status of the investigation and the company voluntarily recalled the almond butter and peanut butter products that were manufactured on the same product line as Trader Joe’s Valencia Creamy Salted Peanut Butter between May 1 and September 24, 2012.

FDA inspectors are continuing their investigation at the Sunland Inc. production facility. On the evening of September 24, Sunland Inc. expanded their recall to about 100 products.
October 5, 2012
The FDA announces that environmental samples taken in the Sunland Inc. nut butter production facility show the presence of Salmonella. Subsequent analysis determined that Salmonella Bredeney with a DNA fingerprint that is the same as the outbreak strain was present in the samples. Environmental samples are samples taken from various surfaces in the production or manufacturing facility that would likely harbor bacteria.
Also, testing conducted by the Washington State Department of Agriculture laboratory isolated the outbreak strain from an opened jar of Trader Joe’s Valencia Creamy Peanut Butter collected from a case-patient’s home.
On October 4, Sunland Inc. expanded its ongoing recall to include all products made in the Sunland nut butter production facility between March 1, 2010 and September 24, 2012. The company reports that it is adding 139 products to the recall, bringing the total number of products being recalled by Sunland Inc. to 240.
The expanded recall covers all previously identified Peanut Butter, Almond Butter, Cashew Butter, and Tahini products as well as Roasted Blanched Peanut Products. New product categories being added to the list are several varieties of flavored butters and spreads, including Thai Ginger Butter, Chocolate Butter and Banana Butter.
The expanded recall adds forty-nine (49) products that are currently within the manufacturer’s recommended shelf-life, that is, the “Best-If-Used-By” dates have not expired. The expanded recall also covers ninety (90) products consumers may still have in their homes which are older than the “Best-If-Used-By Date”.

On October 12, Sunland Inc. expanded its ongoing recall to include raw and roasted shelled and in-shell peanuts sold in quantities from 2 ounces to 50 pounds which are within their current shelf life or have no stated expiration date.

As part of the continuing investigation, the FDA inspected the Sunland Inc. production facilities, which include a building in which peanuts are processed and a separate building in which nut butters are made. On October 13, FDA announced that testing has found the presence of Salmonella in raw peanuts from the peanut processing facility. Environmental samples taken from this building also show the presence of Salmonella.

The FDA has made the observations from its recent inspection of Sunland Inc. publicly available. This inspection was conducted between September 17 and October 16, 2012, and became part of the investigation of the Salmonella Bredeney outbreak linked to peanut butter made by Sunland Inc.
During this inspection investigators found that conditions in the company’s facility, the company’s manufacturing processes, and the company’s testing program for Salmonella may have allowed peanut butter that contained Salmonella to be distributed by the company.
The FDA found that between June of 2009 and August of 2012, Sunland Inc. had distributed, or cleared for distribution, portions of 11 lots, or daily production runs, of peanut or almond butter after its own testing program identified the presence of at least one of nine different Salmonella types (Arapahoe, Bredeney, Cerro, Dallgow, Kubacha, Mbandaka, Meleagridis, Newport, and Teddington) in those lots. Two of these lots showed the presence of the outbreak strain of Salmonella Bredeney.
Equally important, five product samples collected and analyzed by FDA from Sunland Inc. showed the presence of Salmonella, but had not been identified as containing Salmonella by Sunland Inc.’s internal testing. Among those products were peanut butter and shelled raw peanuts. Two of these samples showed the presence of the outbreak strain of Salmonella Bredeney.
Additionally, during its inspection of the plant in September and October 2012, the FDA found the presence of Salmonella in 28 environmental samples. Three of these samples showed the presence of the outbreak strain of Salmonella Bredeney.
Upon identifying the contaminated peanut butter, FDA investigators informed the company and called for corrective action. On October 4, 2012 Sunland Inc. expanded its ongoing recall to include all products made in the Sunland Inc. nut butter production facility between March 1, 2010 and September 24, 2012.
Upon identifying the contaminated shelled raw peanuts, FDA investigators informed the company and again called for corrective action. On October 12, 2012 Sunland Inc. expanded its ongoing recall to include raw and roasted shelled and in-shell peanuts sold in quantities from 2 ounces to 50 pounds which are within their current shelf life or have no stated expiration date.
Additionally, investigators found that employees improperly handled equipment, containers, and utensils used to hold and store food. Employees handling peanut products wiped gloved hands on street clothes and other times failed to wash their hands or change gloves. There were no hand washing sinks in the peanut processing building production or packaging areas and employees had bare-handed contact with ready-to-package peanuts.
There were no records documenting the cleaning of production equipment. The super-sized bags used by the firm to store peanuts were not cleaned despite being used for both raw and roasted peanuts. There was a leaking sink in a washroom which resulted in water accumulating on the floor, and the plant is not built to allow floors, walls and ceilings to be adequately cleaned.
Finally, investigators found that raw materials were exposed to potential contamination. Raw, in-shell peanuts were found outside the plant in uncovered trailers. Birds were observed landing in the trailers and the peanuts were exposed to rain, which provides a growth environment for Salmonella and other bacteria. Inside the warehouse, facility doors were open to the outside, which could allow pests to enter.

First the Chinese chicken jerky, now it's peanut butter...This just shows how important it is for us to be alert and aware in protecting our fourleggers from some of the scary bad stuff out there...and i was actually surprised to see ice cream on the list...i'd never thought about the P.B. in ice cream before...Thanks for sharing
