FDA Issues International Food Safety Capacity-Building Plan under the Food Safety Modernization Act

Food Basket
Center for Food Safety and Applied Nutrition - Food and Drug Administration
February 28, 2013
In 2011, Congress enacted the FDA Food Safety Modernization Act (FSMA), recognizing the unique challenges faced by FDA in the area of food safety in the 21st century. FSMA directs FDA to build a new food safety system based on the public health principle of comprehensive prevention, an enhanced focus on risk‐based resource allocation, and partnerships across the public and private sectors to minimize hazards from farm to table.  In addition, Section 305 of FSMA calls on FDA to develop a comprehensive plan to expand the technical, scientific, and regulatory food safety capacity of foreign governments and their respective food industries in countries that export foods to the United States (the “Plan”). This Plan meets the Section 305 requirement, and does so by incorporating FSMA’s principles of comprehensive prevention, risk-based resource allocation, and partnering.
This Plan provides a strategic framework for FDA’s international food safety capacity-building activities. It outlines goals, objectives, and key actions that will provide a framework for the FDA in setting priorities and managing international food safety capacity building programs.
The Plan will also enable all stakeholders to see the breadth of food safety capacity-building efforts on the part of FDA.   It charts a direction for how FDA will prioritize its capacity-building efforts based on risk, coordinate with other partners to avoid duplication of efforts, and to broaden the reach of technical assistance and capacity-building efforts.   FDA will use data to develop strategies, allowing the agency to make decisions about capacity-building based on identifiable needs, while also allowing the agency to measure the impact of its efforts.
The plan addresses the six elements required by Section 305 of FSMA by incorporating them into four key goals and objectives, as supplemented by additional themes. The Plan’s key goals and objectives are:
  • Ensure efficiency across the FDA Foods and Veterinary Medicine Program
  • Increase effectiveness through evidence-based decision making
  • Support the exchange of information between FDA and other foreign government agencies or other entities
  • Enhance technical assistance and capacity-building in food
The full text of the International Capacity Building Plan is available at FSMA International Capacity Building.

VIA HAND DELIVERY
Notification of Opportunity to Initiate a Voluntary Recall
Raymond J. Kasel, President

Kasel Associates Industries, Inc.

3315 Walnut St.

Denver, CO 80205

Dear Mr. Kasel:

Pursuant to section 423 'of the Federal Food, Drug, and Cosmetic Act (FD&C Act) (21 U.S.C.
3501), as amended by the FDA Food Safety Modernization Act, the U.S. Food and Drug
Administration (FDA) is providing your firm, Kasel Associates Industries, Inc. (Kasel), with an
opportunity to voluntarily cease distribution and conduct a recall of pet treat products
manufactured by your firm from April 20, 2012 through September 19, 2012. Section 423(a) of
the FD&C Act provides in relevant part that if FDA "determines ...that there is a reasonable
probability that an article of human or animal food (other than infant formula) is adulterated
under section 402 or misbranded under section 403(w) and the use of or exposure to such article
will cause serious adverse health consequences or death to humans or animals," before taking
further action under section 423 of the FD&C Act, FDA must offer the responsible party the
opportunity to voluntarily cease distribution and recall such articles (21 U.S.C. 3501(a)).1

As discussed further below, FDA has determined that for those pet treats manufactured at your
Denver facility from April 20, 2012 through September 19, 2012, which bear the lot codes
BESTBY20APR2014 to BESTBY030CT2014 for products with a two year expiry, or
BESTBY20APR2013 to BESTBY030CT2013 for products with a one year expiry (collectively,
affected pet treats), there is a reasonable probability that such products are adulterated under
section 402(a)(1)2 and (a)(4i ofthe FD&C Act (21 U.S.C. 342(a)(l) and (a)(4)) and a reasonable
1 The term "responsible party" is defmed in section 417 of the FD&C Act and refers to the person who submits the registration for a food facility that is required to register under section 415(a) of the FD&C Act (21 U.S.C. 350d), at which the food at issue is manufactured, processed, packed or held. On February 4, 2004, you registered Kasel with FDA pursuant to section 415(a) ofthe FD&C Act (21 U.S.C. 350d(a)). As such, this letter is directed to you as the responsible party.
2 Under section 402(a)(l) of the FD&C Act, a food shall be deemed adulterated if"it bears or contains a poisonous or deleterious substance which may render it injurious to health."

It is a good thing.

Dearest Dakota,

We just learned you crossed the Bridge. You fought such a valiant fight against lymphoma. While we take comfort knowing that you are free of pain, there is such sadness because we miss you already.

Senator Conrad and family, our deepest condolences. Nothing anyone can say or do can fill that emptiness right now. Dakota was special. He was a true Bichon and a fulfilled more than his destiny. He touched lives with the gentle stroke of love and joy that is the essence of our breed.

Dakota, thank you. Thank you for having represented "US" so well. US, rescues. US, Bichons, US, dogs.

We hope your family finds comfort and peace and with time we hope they welcome another rescued dog.

Last night we asked our friends over the Bridge to welcome you with full honors. Dakota, know that you made the world better.

The move comes after the Colorado Department of Agriculture tested a retail sample of a Kasel pet treat product and found it to be positive for Salmonella. Based on FDA’s follow-up inspection at the firm, FDA found that all of the finished pet treat product samples and 48 out of 87 environmental samples collected during the inspection tested positive for Salmonella. More than ten different species of Salmonella were found in the firm’s products and manufacturing facility, indicating multiple sources of contamination.
While there are no reports of human illness, FDA has received a small number of complaints of illness in dogs who were exposed to the treats. Because of the multiple positive tests for Salmonella, and the production practices and conditions observed at the facility during the inspection, FDA believes that there is a reasonable probability that pet treat products manufactured in the facility from April 20, 2012 through September 19, 2012 are contaminated with Salmonella.
Both people and animals can contract Salmonellosis from handling or eating contaminated products. People handling dry pet treats should thoroughly wash their hands after having contact with the treats as well as any surfaces exposed to these products.
Consumers who have any of these products, or who are unsure of the manufacturing date of their pet treats, should dispose of them in ways that people and animals, including wild animals, cannot access them, such as placing them in a securely lidded garbage can.
The Kasel-manufactured products are sold at various retailers, including Target, Petco, Sam’s Club and Costco. Most of the products have a two-year shelf life.
All of the products were made in the U.S. This action is not related to FDA’s ongoing investigation of jerky pet treats made in China.
Salmonella is a public health risk and is one of the most common causes of foodborne illness. Healthy people infected with Salmonella may experience some or all of the following symptoms: nausea, vomiting, diarrhea or bloody diarrhea, abdominal cramping and fever. Although rare, Salmonella can result in more serious ailments including arterial infections, endocarditis (inflammation of the lining of the heart), arthritis, muscle pain, eye irritation and urinary tract symptoms. Consumers exhibiting these signs after having contact with the products subject to this recall should contact their health care provider immediately.
Pets with Salmonella infections may become lethargic and have diarrhea or bloody diarrhea, fever and vomiting. Some pets may experience only a decreased appetite, fever and abdominal pain. Infected, but otherwise healthy pets can be carriers and infect other animals or humans. If your pet has consumed any of the affected product or is experiencing any of these symptoms, contact your veterinarian immediately.
The elderly, infants and those with impaired immune systems are more likely to become severely ill from Salmonella infection. The bacterium can cause serious and sometimes fatal infections in these vulnerable populations. Most healthy individuals recover from Salmonella infections within four to seven days without treatment.
As with humans, dogs who are elderly, very young or have impaired immune systems are more vulnerable to Salmonella infection.
