Are you aiming at fleas and killing your pet?



PetArmor PlusPet owners have filed another class action lawsuit against another manufacturer of popular over-the-counter flea and tick products, claiming their pets died after using the products.


FidoPharm and Velcera have been served in a class action lawsuit claiming their PetArmor and PetArmor Plus "spot-on" flea and tick products are unsafe. Prior lawsuits against the makers of "Frontline," "K9 Advantix," "Advantage," Hartz "Ultraguard" and Sergeant's line of flea and tick products are pending.


"Spot-on" flea and tick products are neurotoxin pesticides which are according to diections, to be placed directly on the skin of millions of household dogs and cats across the U.S. Generally, no mention is ever made in their advertising or marketing or EPA-mandated labeling that the products can actually cause death, or that other serious side-effects can be cause by use of the products. Side effects like paralysis, seizures and skin lesions. Consequently, most consumers are unaware of they risk exposure to their pets even when proper directions are followed on the application of these products.


The EPA has cataloged over 75,000 complaints since 2008 regarding "spot-on" flea and tick products, yet, to date nothing has been done yet to force these companies to correct their advertising and labeling and to alert pet owners about the possible dangerous side-effects. Frustrated and outraged pet owners are turning to legal redress and joining the FDA as a defendant in their class action suits.


Retailers should take note. If you carry and re sell this product, you are not immune. The PetArmor and PetArmor Plus class action lawsuit is brought on behalf of all purchasers of PetArmor and PetArmor accuses Fidopharm, Velcera and Wal-Mart, where the products are sold, of breach of express warranty, breach of implied warranty of merchantability, unjust enrichment, and violation of the Florida Deceptive and Unfair Trade Practices Act, the Arkansas Deceptive Trade Practices Act, and Common Law Fraud.

The other major class action suit on flea and tick products is against Bayer and Merial who stand accused of making make false and/or misleading claims about what their products. The long laundry list of allegedly false advertising claims on their products include:


* are self-dispersing and cover the entire surface area of the dog or cat’s body when applied in a single limited spot;
* are effective for one month and require monthly application to continue to be effective;
* do not enter the blood stream of the pet and instead move across the pet’s skin to cover the pet; and
* are waterproof and remain effective following shampoo treatments, swimming, or after exposure to rain or sunlight.


The Bayer and Merial Flea and Tick Product Class Action Lawsuit is seeking to recover damages on behalf of all consumers-purchasers, as well as an injunction barring Bayer and Merial from continuing to misrepresent what their flea and tick products can do.


So... the thought comes to mind. Are you aiming at fleas and killing your pet? And a step beyond that question... Is your flea product also killing you?
